LoveandMatch.com Terms of Use

These Terms of Use are entered between LoveandMatch.com, Corp (hereinafter “L&M”) and any individual having the quality of Member (hereinafter “you”, “your” or “Member”).

LoveandMatch.com, Corp (hereinafter “L&M”) and the companies of the Indra Holding and Investments, Corp (hereinafter, the “Indra Group”) offer a virtual person-to-person meeting service on electronic communications networks (hereinafter the “Service(s)”) including notably:

The LoveandMatch Service, a dating Service available to Match Members over the Internet or through their mobile phone or applications and/or landline telephone. Some LoveandMatch Service features are available free of charge while others require Members to pay a flat-rate Subscription fee.

The Match Affinity Service, a dating Service offering to bring Members closer together using psychological matchmaking through an exclusive test, the Match Affinity test, available to Match Affinity Members over the Internet. The completion of the Match Affinity test and the resulting psychological matchmaking process are compulsory. Without going through these initial steps, Match Affinity Members will not be able to view the profiles of the other Members who matched their research. Certain features of the Match Affinity Service are accessible to Members free of charge while others require payment from Members.

Other dating Services provided by L&M or other companies of the Indra Group, available to Members or given categories of Members over the Internet or through their mobile phone or mobile applications. Certain features of the Specialized Services are available to Members free of charge while other features require a payment from Members.

Please carefully read these Terms of Use to participate, along with the Indra Group companies and as a Member, in the development of responsible Internet behaviour and the provision of a quality Service. By becoming a Member, you agree to comply with these Terms of Use. If you do not accept these Terms of Use, you must not register for or use the Services. Registration for one or more Services and use of the Services implies the acceptance in full of these Terms of Use by the Member. By ticking the box marked “I certify that I am over the age of majority and have read and accepted the [service name] TOU” at the bottom of the registration page, the Member acknowledges that it is fully informed and bound by the provisions of the Terms of Use. Any special conditions relating to a promotional operation will require validation by the Member at the time of subscription.

The Terms of Use are the property of L&M and of the Indra Group companies. Accordingly, and without this list being exhaustive, any dissemination, exploitation, representation, reproduction or use, in whole or in part, on any medium, of the Terms of Use for purposes other than strictly personal and non-professional, is subject to MIL’s prior authorization. Without this authorization, the infringing party may be liable for criminal offences and subject to criminal and civil prosecution as provided for by law.

Article 1. Definitions

The words or terms used in these Services Terms of Use and beginning with a capital letter shall have the following meaning: “Consumer Contracts Regulations” refers to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
“Subscription” refers to a fixed rate contract giving unlimited access to our paid Services, as required, for a limited period as specified in the specific subscription purchased by a Member. “Match” refers to a set of Services designed to promote person-to-person meetings for personal, leisure and non-commercial purposes. Match is available in multi-access (Internet, SMS, MMS, mobile application, etc.), free of charge or paid, based on the offer the Member enjoys.
“Match Affinity” refers to a set of Services designed to promote person-to-person virtual meetings for personal, leisure and non-commercial purposes using psychological matchmaking by completing the exclusive Match Affinity test, available over the Internet, by Match Affinity Members.
“Match Affinity Test” refers to the psychological test Match Affinity Members are required to take to use the Services. The Match Affinity Test is the heart of the psychological matchmaking service.
“Match Affinity Test Results” refers to the results generated following completion of the Match Affinity Test as a personal report made available to Match Affinity Members.
“Event” refers to one or all of the paid recreational events or activities that allow Members and Visitors to meet in real life. “Member(s)” refers to one (or all) user(s) of one or more Services that validly subscribe to a Match or Match Affinity Subscription or has access to any of the Services after registering free of charge on the Sites.
“Option(s)” refers to the Paid Service(s) subscribed to by the Member to complete its Subscription.
“Service(s)” refers to all services, whether paid or free of charge, available to Visitors or Members, whether Members of Match, Match Affinity or other Services provided by L&M or the companies of the Indra Group.
“LoveandMatch Service(s)” refers to all services, whether paid or free of charge, available to Match Members.
“Match Affinity Service(s)” means all services, whether paid or free of charge, available to Match Affinity Members. “Paid Service(s)” refers to all Paid Services available to Members or Visitors.
“Site(s)” refers to, individually or collectively, the Indra Group’s websites, including www.LoveandMatch.com, the Core Dating Sites and the Specialized Sites as well as mobile applications published by L&M or the companies of the Indra Group and through which the Services are provided.
“Core Dating Site(s)” refers to, individually or collectively, the Site(s) accessible to all Members.
“Specialized Site(s)” refers to, individually or collectively, the Sites reserved to certain categories of Members.
“Upgrade” refers to the paid addition, at the request of a Member, of additional Services to its Subscription.
“Visitor(s)” refers to one or more user(s) accessing and using one or more Events without having registered on the Sites.
“Terms of Use” refers to this contract.
 

Article 2. Access and Registration to Services

2.1. Procedure and terms of access to and registration of Services, Start of contract

2.1.1 General terms of access and free registration

The cost of equipment (computer, software, telecommunications, etc.) enabling access to the Services as well as the communication costs incurred by their use are solely borne by the Member.
Registration is free. It lets Members discover the Services and provides access to the following features:

Services features available to all Members (including Members with free accounts)
Create a profile
View the profiles and photo albums of other Members
Perform quick and advanced searches
Add a Member to your favourites
Reply to e-mails from Premium Members
Register and participate in Events or special operations accessible through the Services
To register and become a free Member, anyone interested in the Services must be at least 18 years of age, meet the requirements for registration or access to the concerned Services, be legally able to contract, not be under guardianship or curatorship, have read and accepted these Terms of Use, the Cookie Usage Policy and the Privacy Policy and have completed all mandatory fields listed on the registration form, including the fields for the following personal information:

Search;
Date of birth;
Country;
Postcode;
E-mail address;
Username;
Password

The Member may then add to its profile by providing information as to its physical appearance, hobbies, profession and any other personal information the Member wishes to publicly disclose to other Members or through the Services, except for personal contact details (postal address, e-mail address, telephone, etc.) the disclosure of which to other Members is expressly prohibited by Match. This information may be modified at any time by the Member from the “My Account and Subscription” section.
The Member warrants that the information it communicates is accurate. The Member agrees to immediately inform L&M of any changes to the data provided at the time of registration and, if necessary, to make these changes on its personal space on the Sites. When the terms and conditions for registration are met, each Member has a username (name indicated by the Member) and a password, which are strictly personal and confidential and which must not be communicated or shared by the Member with third parties.
Except in the event of L&M’s own wrongdoing or technical failure of the Service(s), the Member will be responsible for the use of its username and password or other identifiers by third parties or actions or statements made through the Member’s personal account, whether fraudulent or not, and will indemnify and hold L&M harmless against any claims in this respect. Furthermore, L&M is not required and does not have the technical means to ensure the identity of the persons registering for its Services. If a Member has reason to believe that a person is using its username and password or account, that Member must immediately inform L&M.
When a Member wishes to sponsor a friend and provides the Indra Group company providing the Services with the contact details of this friend, that Member undertakes to obtain that friend’s express consent to the processing of its data by the companies of the Indra Group which will only be used to send, on behalf of the Member who provided L&M with its contact information, an electronic message informing this friend about the Services. Where appropriate, the Member will provide such information voluntarily and freely and under its exclusive responsibility.

2.1.2 Terms of access and paid registration

The Member has the possibility to subscribe to a paid subscription, with or without options, and therefore to benefit from the following features:

Services features available to any Member (including Members with free accounts):
Create a profile
View the profiles and photo albums of other Members
Perform quick and advanced searches
Add a Member to your favourites
Respond to emails from Premium Members
Register and participate in Events or special events accessible through the Services

Features only available to Members with a Subscription:
Send and respond to emails
Access the section “Who Im looking for” of Members
Hide Members you are not interested in
Access the list of “flashes” sent
Send a “flash” to another Member
Benefit from price reductions for Events
Turn off advertisements
To obtain a paid Subscription and gain access to all the features of the Site and Services accessible to it, the Member must first identify itself using its e-mail address and password.
After having entered its personal data and chosen its Subscription and method of payment, the Member must confirm payment. This last step formalizes the entering into the subscription contract to the Services in accordance with Article 9 of these Terms of Use.
Input errors may be corrected at any time before the contract is submitted and before clicking on the “Confirm Payment” button. By clicking on the “Confirm Payment” button during the purchase process, after checking the contents of the purchase and making any changes deemed necessary, the Member accepts these Terms of Use in full without reservation. Once payment is confirmed, an overview of the payment order, including the purchase reference, the duration of the chosen Subscription, the invoice amount and the invoice date will be displayed. L&M will also acknowledge receipt of the purchase by e-mail as soon as it is confirmed. This e-mail will include the main features of the service subscribed to, the duration of the subscription, the invoice cycle, the invoice amount and these Terms of Use containing L&M contact information. As a security and quality measure, L&M may deactivate accounts of Members who have not used the Services for 6 (six) months, or more and for whom no Subscription remains valid. In the case of paying Members, this six-month period begins on the date that the last Subscription expired
In addition, any messages exchanged through the Sites and saved by the Member on its account are automatically deleted at the end of a one-year period. The information contained in the different lists (visits, favourite profiles, photos revealed, etc.) are deleted after six (6) months.

2.2. Right to cancel registration

Pursuant to the Consumer Contracts Regulations, the Member has fourteen days from its subscription to the Services to exercise its right to cancel its registration, without penalty and without reason, by either filling out the cancellation form downloadable here or by writing a clear and unambiguous statement that the Member wishes to cancel and sending its completed cancellation form or statement by regular post sent to us by email to info (@) loveandmatch.com. Only applications related to the exercise of this right to cancel will be processed from these contact addresses. The cancellation period expires fourteen days after the contract conclusion date. Additional information about the scope and application of the right to cancel is also available on the Help page.
To comply with the cancellation period, the Member need only submit the cancellation form or clear and unambiguous statement of cancellation before the expiry of the cancellation period.
Pursuant to the Consumer Contracts Regulations, L&M must obtain the express request of the Member if the Member wishes to have access to the Service(s), before the expiry of the fourteen-day period within which the right to cancel may be exercised. This express request is obtained by L&M directly after taking out a Subscription. The Member will be directed to a payment confirmation page displaying the details of the Subscription and any Option(s) to which the Member has subscribed as well as the fee paid by the Member. A clickable button on the page will ask the Member if it wishes to immediately access the Service(s). This button is accompanied by an explanatory note and link to these Terms of Use for more information. If the Member does not wish to have immediate access to the Service(s), that Member may leave the Site and wait until the expiry of the cancellation period. However, if the Member connects to its Match account before the expiry of this period, L&M will deem this initial connection following taking out a Subscription as an express request from the Member to have immediate access to the Service(s).
If the Member requests to begin the performance of Services during the cancellation period, he/she shall pay L&M an amount which is in proportion to what has been performed until the Member have communicated to L&M his/her cancellation form the Services, in comparison with the full coverage of the Services.
Pursuant to the Consumer Contracts Regulations, in the event the Member has requested the performance of the Service(s) to begin during the cancellation period, he or she shall pay an amount proportionate to the Service(s) provided to him or her until L&M has been informed of the exercise of its right to cancel, prorated from the total price of the Service(s). In such case, L&M will refund the Member of the difference between the amount paid at the subscription of the Service(s) and the amount equal to the prorated number of days elapsed between the day of the subscription to the Service(s) and the day of cancellation, provided that any day of the Subscription that is started is counted as a day on which the Service(s) are provided. The reimbursement will be made within fourteen days from the date L&M is informed of the Member’s decision to cancel, by the same means of payment as those used by the Member for the initial transaction, unless otherwise agreed by the Member.

2.3 Terms of access, registration and cancellation applicable to Events



2.3.1 Terms of access and registration for Events

To register for Events on the dedicated Site, any person interested in doing so must be a Member. Any Member interested in a paid registration for one of the Events, must first sign in with an e-mail address and password and must accept these Terms of Use to be able to register for any Event as a Member of the Service.

The registration process on the dedicated page is as follows:
The Member clicks on the chosen Event to access the description file;
The Member enters the requested information and accesses the summary sheet containing the name of the chosen Event and the total registration price;
The Member selects the payment method and then confirms registration to the Event, subject to the condition of acceptance of these Terms of Use when registering for the LoveandMatch Service. Once payment is confirmed, an overview of the payment order, including the purchase reference, the chosen Event, the invoice amount and the invoice date will be displayed. L&M will also acknowledge receipt of the purchase by e-mail as soon as it is confirmed. This e-mail will include the essential elements of the Contract, including the Member’s username, the identification of the Event selected, the invoiced amount and these Terms of Use including L&M contact information.
Before confirming its registration for the selected Event, the Member must ensure that all information displayed conforms with the information given, as this information will no longer be able to be changed after the registration has been confirmed. The registration constitutes a definitive commitment by the Member, who may only cancel the contract under this terms.

Article 2.3.3 below.

2.3.2. No right to withdraw from Match Event

The Member is hereby informed that Events are not subject to a right to cancel, in accordance with regulation 28(1)(h) of the Consumer Contracts Regulations. As a result, any registration to Events carried out on the Site is subject only to the cancellation conditions provided for in Article 2.3.3 below and the Member may not invoke the right to cancel.

2.3.3. Match Event cancellation policy

Members may cancel their registration for any Event up to 72 hours before the date of the Event. Beyond this period, L&M reserves the right to examine any request for cancellation on a case-by-case basis after receipt of supporting documents. Any request for cancellation must be made as indicated in Article 12 of these Terms of Use or by any means permitting confirmation of receipt, using the contact details indicated herein. The date of receipt of the aforementioned confirmation will be the date used for the calculation of the costs referred to below.
In the event of cancellation by a Member, only the price of the Event will be refundable. In all cases, no costs of any kind whatsoever will be refunded or compensated.
If the Member does not attend or is unable to participate in the Event at the times and places indicated in the Member’s contract, no amount will be reimbursed.

Article 3. Use of Services

Once registered, and subject to having subscribed to the Subscription Forms offered, the Member will have access to the Services, in accordance with its Subscription.
The Member will be able to access all the Core Dating Sites and its Member Profile will be visible to other Members and Visitors of the Core Dating Sites. The Member will be able to contact the Members of the Core Dating Sites which profiles are accessible, subject to potential restrictions imposed by said Members.
The Member will not be able to access the Specialized Sites with its Match account. In order to be able to access a Specialized Site, the Member shall register on said Site by creating a new specific account on said Specialized Site. However, the Member’s profile will be visible to the members of a Specialized Site if the Member meets the requirements applicable to the members of the Specialized Site in question. Should the Member wish not to be visible on the Specialized Sites but wishes to be contacted on said Specialized Sites, it may modify such parameters on the “My account” section available from its Member account. The prices and terms of payment for the various Paid Services are detailed under the section entitled “Prices and Terms of Payment” of these Terms of Use and are accessible at any time on the Sites during the presentation or use of the Paid Service(s) to which the Member wishes to subscribe, as well as its (or their) respective rate(s).

3.1. L&M’s obligations pertaining to the Services

The purpose of the Services is neither marital counselling nor marriage brokering with a view to achieving a marriage or establishing a stable union, regardless of the Member’s personal motivations in this respect at the time of registration. The purpose of the Services’ does not cover the organization of “actual” encounters or the provision of access to the Internet or the provision of an electronic communication service to the public. As a result, L&M and the companies of the Indra Group do not have a legal obligation to verify the actual identity of Members when they connect to the Sites or to control the content, information and statements posted by Members. As L&M and the companies of the Indra Group cannot technically provide such services, they do not contractually undertake to verify the identity of the Members or of their members or the truthfulness of the content they post under their exclusive responsibility, nor to moderate such content, except their photograph(s) and posts on their profile page.
It is important to take certain precautions when meeting with another Member or another member of a Specialized Site. L&M and the companies of the Indra Group disclaim all liability as regards meetings between Members during the use of the Services or during meetings between Members and/or non-Members following the use of the Services. In addition, during a first physical meeting, Members are advised to inform an emergency contact and to meet in a public place (cafe, restaurant, etc.). L&M and the companies of the Indra Group also disclaim all liability for acts of any kind committed by its Members or Visitors during the running of the Events, however L&M and the Indra Group companies do not limit or exclude their liability to you for: (i) death or personal injury caused by the negligence of L&M or a Indra Group company; (ii) fraudulent misrepresentation of L&M or a Indra Group company; or (iii) any other liability that may not be limited or excluded under USA law.
To this end, L&M reminds Members that they are prohibited from indicating or disclosing to other Members or third parties any information permitting their identification (except for usernames), such as surname, postal and/or electronic address and telephone number, to other Members through the Services.

3.2. Member’s obligations

The provisions of this Article also apply without prejudice to the Article entitled “Termination”.
As part of the use of the Services, the Member agrees to comply with the laws in force and respect third-party rights and the provisions of the Terms of Use.

3.2.1. General obligations:

The Member’s general obligations are as follows:

Conduct itself in an honest manner with respect to L&M and other Members.
Not infringe the intellectual property rights of the content provided by MIL, the companies of the Indra Group and other Members.
Ensure that it does not reveal any information about its private life the dissemination of which could be harmful to the Member or its reputation.

3.2.2. Essential Obligations:

The Member’s Essential Obligations are as follows:

Not to use the Services for professional, commercial, income-generating (advertising, prospecting, etc.) or non-personal purposes.
Not to use the Services for solicitation or prostitution.
Not to post, indicate or disseminate, in any form whatsoever, information or content that is inconsistent with reality. Refrain from posting any statement or content that violates the rights of others or is defamatory, abusive, obscene, offensive, violent or incites violence, political, racist or xenophobic and, in general, any statement or content contrary to the purpose of the Services, the laws and regulations in force in the territory from which the Member accesses the Services, the rights of other persons or public morals. In particular, photos and any information, data or files provided by a Member to L&M must be decent and relate only to the Member or, if they relate to a third party, must only be provided with that third party’s express consent. Not to post on the Site any personal information provided by a Member to L&M (e-mail address, postal address, telephone number, etc.) that would allow a Member to contact another Member without using the Services.
Not to post, disclose, or disseminate in any form whatsoever information or content that has the effect of diminishing, disrupting, preventing the normal use of the Services, interrupting and/or slowing the normal flow of communications between Members through the Services, such as software, viruses, logical bombs, mass mailing, etc. L&M and the companies of the Indra Group reserve the right to delete mass messages sent by a Member to preserve the normal quality use of the Services. Not to post, disclose, or disseminate in any form whatsoever information or content incorporating links to third-party sites that are illegal, contrary to morality and/or not in conformity with the purpose of the Services.
Only the Member may use its password and/or username to access the Services. In this regard, the Member will not, without this list being exhaustive, communicate, disseminate, share, make accessible, in any way whatsoever, its passwords and/or usernames to any third party.
Not to provide email addresses to L&M or a Indra Group company of other persons or publish or send any information referring to other persons without having obtained their prior consent.
Use the Services in accordance with the purpose described in the Terms of Use.
A breach of the Essential Obligations constitutes a serious breach by the Member of its obligations. Without prejudice to the provisions of the Article entitled “Termination”, in the event a Member fails to fulfil one or more of these Essential Obligations, L&M may terminate the contract and permanently delete the Member’s account(s) on the Sites and Services. Similarly, any Member who fails to strictly comply with one of these Essential Obligations during Events could be banned from the Events and Services.

Article 4. Fees, Terms of Payment and Renewal

4.1. Fees, terms and conditions of payment

The use of Paid Services may only be made where the Member has a Subscription. Members may purchase a Subscription either by bank card (on the Internet or through a mobile service or by telephone) or by participating in games or Services offered by L&M or the Indra Group companies on Services.
The fees and terms of payment for these various Paid Services are at all times available during the introduction or use of the Paid Service(s) to which the Member wishes to subscribe as well as its (or their) respective rate(s).
Fees are quoted in pounds, all taxes included.
The purchase of a Subscription or an option through a Member’s account is virtually instantaneous from the validation of the transaction by Bank Card.

4.2. Subscription renewal terms and conditions

Members may, at any time, give notice to L&M of their intention to terminate their Subscription without fees other than those that may be incurred in submitting their request. This termination takes effect on the expiry date of the current Subscription, provided that the notice is made by the Member no later than 48 hours prior to the expiry date of the current subscription, in accordance with the provisions of Article 8 below entitled “Termination”.
On the expiry of a Subscription, this Subscription will, unless the Member sent notice of the termination to L&M prior to the expiry of the current Subscription in accordance with the terms and conditions indicated, be successively renewed for periods equivalent to that originally opted for by the Member. The extended Subscription will be charged to the Member on the basis of the base rate and the duration of the subscription initially taken out by the Member. The Member may terminate the extended subscription for an indefinite period at any time, which subscription will then expire at the end of the current subscription period, provided that the notice is made by the Member to L&M no later than 48 hours prior to the expiry date of the current Subscription.
In addition, comparable information on the Membership Subscription deadline is always available to Members in the “My Subscription” section, which allows them to manage their Subscription and account options.

4.3. Terms and conditions for upgrading a L&M Subscription

The Member may also subscribe to other one-time services, such as purchasing smartphone applications or special offers. Where applicable, these one-time services are purchased from other service providers and subject to other payment terms and conditions than those used for the Services offered by Match (e.g. iTunes for the purchase of an iPhone application), which will be provided by the relevant service providers. The billing and payment terms and conditions and the terms of renewal specific to these one-time services and special offers will be given to the Member by the relevant service provider and accepted by the Member prior to purchase.
Throughout the Subscription, the purchase of applications for smartphones does not give access to Paid Services.

Article 5. Members’ Privacy and Data Protection

5.1. General information

This Privacy Policy applies to all Sites and Services provided by the Indra Group.
The terms “we” and “our” and “us” refer to the Indra Group as defined in the applicable terms and conditions, and according to the operation of the Services.
We enforce the highest standards with respect to Members’ privacy and personal data protection and we answer to the Information Board Office in the USA for the personal data processing we operate and have made a notification to the USA Information Commissioner. Our technical teams make every effort to ensure the security of all of our Sites and Services. Internet security is a complex issue and no information system can be seen as perfectly secure. Should a security breach be discovered, we will use our best efforts to act as soon as possible to remedy the breach. In order to improve the level of protection of your personal data that is not under the control of the Indra Group, we suggest that you use software devices that protect data transmission networks (such as antivirus systems and updated firewalls and anti-spam filters).
Online payments on the Sites are secured through https protocol in order for your data to be encrypted during their transmission to the payment processor.
We will not collect, process or use your data unless necessary for the performance and improvement of the Services and to the extent necessary, if you have consented to or not objected to it, or if required or permitted by applicable governing laws. Generally, we will only collect this data from you and will tell you why. If we do not collect this data directly from you, we will notify you. The same applies to cookies, the use of which is described in our cookie policy.

5.2. When and why do we collect information about you?

We must collect information about you when you sign up for one or several Services, browse the Sites, enter a contest, answer a survey, participate in a discussion, purchase a subscription or send us a message from the contact page. Some information is required to access the Services. Required responses will be marked by an asterisk or otherwise indicated for each applicable question. In the search criteria form or the L&M Affinity Test, the nature of the Service requires a majority of responses for the Service to be effective.
The data provided during registration, as well as the data voluntarily provided as part of your profile (e.g. date of birth, nationality, ethnic origin, clothing style, education/degrees, lifestyle, tastes in music or films, pets, religion and income) help us match you to other Member profiles from the Indra Group’ Sites or who are registered with one or several Services, and help us customize advertisements or special offers or services through the Services.
We may keep your contact details if you visit our Site, even if you do not complete your registration.

5.3. What information do we collect?

The personal data we collect may include your name, postal and electronic address, mobile or landline phone number, banking information, information about your physical appearance, photographs, voice recordings, videos, your city and region, your personal values and interests and your use of the Services.
Some information and comments or content (e.g. photographs, videos, profile, lifestyle) optionally provided by the Member may, under the responsibility and initiative of the Member concerned, reveal the Member’s ethnic origin, nationality, religion or sexual orientation. By providing this optional information and by ticking the consent box displayed on the registration page, the Member concerned expressly accepts and assumes full responsibility for the processing of this “sensitive” data by the companies of the Indra Group providing the Services accessible to the members of the Sites including the Code Dating Sites and Specialized Sites, as well as their service providers located in and outside the USA.
We also collect technical data such as your Internet browser (Firefox, Chrome, Safari, Netscape, Internet Explorer, etc.), operating system (Windows, Mac, Android, iOS, Windows Phone, etc.) and the IP address of the system used, the identifying information of your computer or other device used to visit the Site, all with respect to both the Member and any other Visitor. Finally, the Services operated by the Indra Group may use cookies or equivalent technologies designed to store Members’ identifying information while browsing the Services and to understand the Members’ use of these Services, mainly to improve the Services and Members’ browsing experience on the Sites. 5.4. Sensitive data

Any information or content concerning racial or ethnic origin, political, philosophical or religious opinions, trade union membership and health or sex life is sensitive data. This sensitive data is likely, under the liability of the Member disseminating same, to disclose the Member’s ethnic origin, nationality, religion and/or sexual orientation. By providing such information, the Member concerned expressly consents to the processing of this data by the Indra Group and assumes sole responsibility and liability for same.

5.5. Who has access to this information?

Information about you obtained when subscribing to our Services help us offer you other Services. We have taken all precautions in our databases to archive your information in a secure environment. Only a small number of our employees have access to your information, which may only be accessed in the event of need.
The information contained in your personal ad, your search criteria and your profile may be accessed from and are visible on all the Indra Group’s Sites, on the Internet, by e-mail (newsletter), by mobile phone. In addition, we may disseminate this information directly through the Services or our partners to persons interested in the Services, through newsletters or third-party websites or through any other electronic (e-mail, text messaging, etc.) or audiovisual (radio, television, etc.) communication tools or in the print media (newspapers, magazines, etc.) to increase your chances of meeting someone by promoting your personal ads, search criteria and profile.
As a result, by providing their information through the Services, Members expressly authorize the Indra Group to reproduce and disseminate the information contained in personal ads, their search criteria and their profile (personal data, description, images, video, etc.) on all the Services and the Sites, on the Indra Group’s mobile application, on the Internet, by e-mail) and/or generally on all distribution media, in particular, audiovisual communication (press, radio, analogue television, digital, cable or satellite television) or electronic communication (e-mail, Internet) throughout the world, including outside the European Union, for the duration specified in these Terms of Use between Members and the company of the Indra Group to which it provided its information.
The processing carried out by other companies of the Indra Group is subject to the individual privacy policy of each of these companies, where applicable. We may send you commercial offers for some of our partners, provided that you have given your explicit and informed consent relating to said commercial offers during registration, unless, during registration, you opt not to be contacted or you indicate any time thereafter that you no longer wish to be contacted. If you do not wish to receive a special offer from the Indra Group or our partner companies, please let us know during registration or at any time by going to “My Account” section accessible on your Match account or by sending us a letter.
The Indra Group may share socio-demographic information with partners without indicating names, to enable said partners to target their advertisements (by age, gender, etc.). In this case, we will not send these partners information that would enable them to identify you. We may also share with selected partners information related to your location, to enable them to target their advertisements (by age, gender, etc.) if you have enabled this feature.
For the purposes of current data protection legislation in the European Economic Area (“EEA”), the Service data controllers are the Indra Group companies, including L&M (postal address: PO Box 64197, London, WC1A 9FG, UK).
By providing information through the Services, Members expressly authorize the Indra Group to which they have supplied this information, to transfer this information and the benefit of the above-mentioned rights to the other companies of the Indra Group to service providers and any successors of the relevant Indra Group entity, located within or outside the European Union, as applicable.

5.6. Managing your information

Although only Registered Members can view the data, you should be aware that you are acting in a public space and are responsible for your privacy. You have the opportunity to actively influence what other Members think of you. To keep your information private, go to your profile and choose the option “only me” or do not add the information in question to your profile.
Moreover, there are several options available to select who can see your profile or if other Members can see that you are online. If you wish, you can also temporarily disable your profile.
Finally, you can set the number of notifications and the information you want to receive from us. In the “profile and account/settings” section of your account, you can indicate whether you want to be notified when a message is received and your profile is viewed by a Member or if you would like to receive special offers from us.
Members may access or request access to their personal data to modify or delete this data or to request us to stop using it. Members may send their request by writing to us at the following address: L&M (postal address: PO Box 64197, London, WC1A 9FG, UK) or by filling out the contact forms. You may exercise similar rights granted by other Indra Group companies through the “My Account” section or by writing directly to the entity concerned at its postal address.
You may unsubscribe at any time from our personalized offers in the “Account/Settings” section. You may also refuse certain uses of your data, in particular their use for promotional purposes or to create user profiles under pseudonyms for advertising purposes, by the means described above. However, please note that the creation of user profiles is an integral part of our service, for example, to provide you with suitable meeting proposals.
If you no longer wish the Indra Group or its partners to reproduce or disseminate the information contained in your personal ad, your search criteria or your profile, you may cancel your account according to the terms and conditions of Article 8 entitled “Termination”. Since this information consists of your personal ad, your search criteria and profile, the termination will not take effect until the next update or the next version of these communications (printed, press, audiovisual or electronic) containing your personal ad, your search criteria and your profile information.

5.7. Links to other websites

This privacy policy does not apply to third-party websites which are external to the Indra Group Sites (the “External Websites”) and the Indra Group companies are in no way liable for the privacy policy of these External Websites. If Indra Group companies provide hyperlinks to External Websites, they do not recommend the use of these other websites and give no guarantees as to their content or the products and services furnished and sold by these External Websites.

Article 6. Intellectual Property

6.1. Content disseminated on the Services

All Services names, trade marks, logos, graphics, photographs, animations, videos and texts contained on the Sites and within the Services are the property of the Indra Group and may not be reproduced, used or displayed without the express authorization of MIL, the Indra Group companies or their partners.
The rights of use granted to the Member are limited to private and personal use as part of and for the duration of the registration for the Services. Any other use by the Member is prohibited.
The Member is prohibited from, among other actions, modifying, copying, reproducing, downloading, broadcasting, transmitting, commercially operating and/or distributing the Services, Site pages or the computer code of the Services and Sites, in any way whatsoever.

6.2. Content disseminated by Members

Members grant the Indra Group a licence to use the intellectual property rights arising from the content provided by Members in connection with their registration and use of the Services or the display of its profile on the Services. This licence includes, but is not limited to, the right of Indra Group to reproduce, represent, adapt, translate, digitise, and use for the purposes of the Services, or sub-license the content provided by the Member (information, images, description, search criteria, etc.)on all or part of the Services (on the Sites, by e-mail) and on all the Sites, in the mailing campaigns carried out by the Indra Group and, in general, on all electronic communication media (e-mail, SMS, MMS, WAP, Internet, mobile application) as part of the Services. The Member expressly authorizes the Indra Group to modify this content to comply with the graphic charter of the Services or other communication media referred to above, and/or to bring it into compatibility with its technical functionality or the formats of the media in question. These rights are granted worldwide and for the duration of the Terms of Use between the Member and the Indra Group. The Member may not copy, reproduce, or otherwise make use of the content produced by other Members, other than for the strict purposes of the use of the Services for personal and private purposes.

Article 7. Liabilities and Representations and Warranties

7.1. Operation of Sites and Services

To use the Services, Members must have the equipment, software, and parameters necessary for the correct operation of the services, including the latest version of an Internet browser, with JavaScript functions activated, Session cookies permitted and acceptance of pop-ups.
The use of the Services on a Mac requires the exclusive use of the Mozilla Firefox browser - L&M does not guarantee optimal operation with the Safari or Opera browsers.
Notice: for the full use of our Services, you will need to have installed the latest version of the Adobe Flash software (downloadable from “www.adobe.com”). Depending on your network configuration (protected by a firewall or proxy) the connection with our sites might not be possible.
Members must have the abilities, materials and software required for the use of the Internet or the Services mobile application, if applicable, the Internet services, and acknowledge that the nature and constraints of the Internet do not guarantee the security, availability and integrity of the transmission of data over the Internet or through mobile applications. Indra Group companies do not guarantee that the Services will be able to be used if Members use a “pop-up killer” tool; in this case, this function must be disabled prior to the use of the Services.
Indra Group companies do not warrant that the Services will function properly if the Members Internet service provider fails to provide an adequate level of service. Similarly, if applicable, the use of smartphone applications, whose use Members have agreed on directly with the provider, requires Members to have a smartphone and a satisfactory connection.
Under these circumstances, the Indra Group companies are not responsible for any lack of functionality, lack of access or poor conditions of use of the Sites that would be attributable to equipment-related inadequacies, to the internal failures of Members’ access provider, the overloading of the Internet network and for any and all other reasons external to L&M, which the Member agrees are events of force majeure.
The operation of the Services may be interrupted momentarily due to maintenance, updates or technical improvements, or to update the content and/or the way it is presented. To the extent possible, the Indra Group companies will notify their Members prior to any maintenance operations or updates.

7.2. Information and content provided by Members

7.2.1. Information provided by a Member to any company of the Indra Group including to L&M, must be accurate and true. A Member may disclose information voluntarily and the consequences that disclosing this information may have on the Member’s life or the lives of other Members are the exclusive responsibility of the Member in question. The Member, on its own account, discloses and disseminates information, data, texts, content and images that concern it through the Services. Accordingly, the Member waives the right to make any claim against the Indra Group in particular on the basis of the possible infringement of its image rights, honour, reputation or privacy of its private life, that may result from the distribution or dissemination of information that concern it under the terms and conditions established in the Terms of Use, in particular, Article 5, “Members’ Privacy and Data Protection”, to the extent that the Member has previously given its voluntary and express consent to such dissemination as a result of its registration with the Services and in application of the Terms of Use.

7.2.2. The Indra Group cannot be held liable for the accuracy or inaccuracy of the information and content provided by other Members, visitors to the Sites and/or the Member itself (and the consequences of reliance on any such information). Similarly, the Indra Group cannot be held liable for any content disseminated by a Member that may potentially constitute a breach of the rights of one or more of the other Members or third parties, where a member of the Indra Group can demonstrate that it: (i) was not informed by a Member or third party, or about the content or the dissemination, (ii) did not have actual or prior knowledge of the same or (iii) did not commit a breach in the performance of any of its contractual obligations which led to such content being disseminated.
The Indra Group may only be held liable by a Member if and to the extent there is proof of a breach having been committed by Match or one of its service providers involved in the performance of the Indra Group’s contractual obligations, and this breach has caused the Member direct damage. Where appropriate, it will be Indra Group’s responsibility to demonstrate that it has not committed any breaches in the performance of its contractual obligations. The Indra Group may not be held liable for any direct or indirect damage incurred by the Member in the event the Member causes the damage or the damage results from an event of force majeure.

7.2.3. The quality of the Services demanded by both the Indra Group and its Members requires that Members conduct themselves ethically, and behave with respect for the rights of third parties, and the respect for the laws and regulations in force. To meet this demand for quality, individual responsibility and ethics, the Indra Group requests any Member to report any data (photography, text, video), behaviours or comments made by another Member that appear to be in violation of the laws and regulations in force, concerning the purpose of the Services, third-party rights or public morals.
As a result, Members acknowledge and accept that the data they provide, as well as their behaviour or comments made through the Services, may be reported by other Members and are subject to acts of moderation and/or oversight by the Indra Group on the basis of objective assessment criteria. In the event that Match’s investigation of a report reveals that a Member violated the laws and regulations in force or its contractual obligations, the provisions of the Terms of Use, in particular, Article 8 entitled “Termination”, may be applied. Depending on the Members’ behaviour or the comments made by Members, the monitoring team may decide to block any new registration by a Member that has been the subject of a complaint.

7.2.4. In the event the Indra Group is held liable on the basis of a Member’s breach of its legal obligations or those under the Terms of Use, said Member agrees to indemnify and hold the Indra Group harmless against any orders issued against it resulting from the Member’s breach of its obligations.

7.3. Links and external resources

The Indra Group is only liable for the hyperlinks it creates, and does not exercise any control over the External Websites and external resources (third-party websites or mobile applications, social networks, etc.) to which the hyperlinks accessible on the Sites and the Services redirect and which any entity of the Indra Group did not create. It cannot be held liable for the provision of hyperlinks to External Websites, and cannot be held liable for their content, advertisements, products, service features or any other information available on or based on the use of such External Websites.
Any issues relating to a link must be submitted to the administrator or webmaster of the site in question. A Member’s access and/or use of these sources and External Websites may be governed by third party terms and conditions over which the Indra Group has no control.
Finally, if during the course of a search conducted on the Sites, the result of this search leads a Member to results that include External Websites, pages or forums whose title and/or content constitutes a violation of applicable law, that Member is requested to terminate its search of, or navigate to, the External Website in question. Members who continue to search, or navigate to, such External Websites proceed at their own risk, and Indra Group will not be liable for the content of External Websites.

7.4 Indemnity

You agree to indemnify us (including our directors, officers, employees, subcontractors, agents and affiliated companies) against all third party claims and liabilities related to your breach of this Agreement and/or to your use of the Services.

7.5 Functioning of the Site and Services

To use the Services, the Member must have the necessary hardware equipment and software and the necessary parameters required to properly use the website e.g. access to the Internet. Members are also advised to have JavaScript functions, cookies and pop-ups enabled.
The Member must have the skills, hardware and software required to use the Internet or, as appropriate, Internet, telephone and Audiotel Services, and acknowledges that the characteristics and constraints of the Internet mean that the security, availability and integrity of Internet data transmissions cannot be guaranteed.
We do not guarantee that the Services will function if the Member activates a pop-up killing tool. In this case, the function should be deactivated before using the Service.
We do not guarantee that the Services will be usable if the Members Internet Service Provider ("ISP") is unable to provide its services properly. In this context, we cannot be held responsible for the non-functioning, unavailability or adverse conditions of usage of the website resulting from incorrect hardware, problems experienced by the Members ISP or blockages on the Internet networks or for all other reasons outside our sphere of influence. Moreover, due amongst other things to the specifics of their Internet browser, Members connecting through AOL may encounter problems making our sites function properly. Furthermore, smartphone applications are only available to our Members in possession of the smartphone handset and Internet access is required.
Under these conditions, we do not guarantee that the Services shall function without interruption or error. In particular, the use of our website may be interrupted at any time for the purposes of maintenance, updates or technical improvements, or to develop its content and/or presentation. Whenever possible, we shall inform Members prior to maintenance work or updates. Apple users should use Mozilla Firefox - we do not guarantee optimal functioning of the website when using Safari or Opera browsers.
Please note that up-to-date Adobe Flash software may be required for this website to function properly (download from: http://adobe.com/getflash). Depending on your network configuration (if protected behind a firewall or proxy), connection to our Messenger service may not be possible.

Article 8. Termination

Members may terminate their subscription to the Services by requesting the closing of their Match account at any time without reason by making a request through the “My Account” section of the Sites dedicated to this purpose or by any means which may be indicated under this heading. This request will be deemed made on the working day following the receipt by L&M of the request to close the account concerned. This request will not entail reimbursement to the Member of the period remaining until the Member Subscription expires.
The termination of a Subscription by a Member takes effect on the expiry date of the current Subscription, provided that notice was made by the Member to L&M no later than 48 hours prior to the expiry date of the current Subscription.
Without prejudice to the other provisions of the Terms of Use, in the event of a serious breach of the Terms of Use by the Member, L&M will terminate the Member’s account without prior notice or formal notice. This termination will have the same effect as the termination by the Member. Similarly, L&M may exclude and ban any Member that does not strictly comply with one of the Essential Obligations set out in Article 3.2 hereof from Match Events.
This termination will take effect without prejudice to any damages L&M, the Indra Group Companies, its or their successors and/or authorized representatives may claim from Members as compensation for losses incurred by L&M and/or its successors and/or authorized representatives as a result of these breaches.
The Member will be notified by e-mail of the termination or confirmation of the termination of its account. Data relating to the Member will be destroyed at the request of the Member or at the expiry of the current statutory period from the termination of the Member’s account.
As indicated in Article 4 of these Terms of Use, the Member may also subscribe to other one-time services, such as purchasing smartphone apps and/or special offers. Where applicable, these one-time services are purchased from other service providers and subject to other payment terms and conditions than those used for the Services offered by L&M (e.g. iTunes for the purchase of an iPhone application), which are issued by the other relevant service provider. The billing and payment terms and conditions and the terms of renewal specific to these one-time services and special offers will be given to the Member and accepted by the Member by the relevant service provider prior to purchase.

Article 9. Agreement with the Member

These Terms of Use constitute a contract that governs relations between the Member and L&M. These Terms of Use supersede all previous provisions not expressly referred to or appended and constitute the entire rights and obligations of L&M and the companies of the Indra Group and the Member with respect to their subject matter.
If one or more provisions in the Terms of Use are held to be unenforceable under applicable laws or regulations or as a result of a final decision of a competent court, the other provisions will remain in full force and effect, to the extent permitted by that decision. Furthermore, the failure of a Party to act with respect to a breach by the other Party of any of the provisions of these Terms of Use does not in any way imply a waiver of the right to act at a later date with respect to that breach.

Article 10. Modification of the Services or Terms of Use

L&M may amend these Terms of Use at any time. Notice of the nature of these amendments will be sent to Members as soon as they are posted on the Sites. The amendments will come into effect one month after they are posted on the Sites. With respect to Members registering after the amendments are posted on the Sites, these amendments will immediately apply, as they will have expressly accepted them by becoming Members. Upon the issuing of an amendment to a Member, the Member will have several options:

10.1. The Subscription initially taken out by the Member has not yet expired

In this case, the Member may choose to comply instead with the Terms of Use that were in force on the date that the Member’s initial Subscription started until the expiry of that initial Subscription.

10.2. The Member’s initial Subscription period has expired

In this case, the Member may implement the procedure referred to in Article 8 entitled “Termination” at any time during the four (4) months following the date of entry into force of the new Terms of Use. Beyond this four-month period, if the Member has not made known its intention to terminate its account, the Member’s acceptance of the new Terms of Use is implied. Members are accordingly invited to consult the version of the Terms of Use in force available on the Sites at all times.

Article 11. Applicable law - Disputes

These Terms of Use are governed, interpreted and applied in accordance with USA law, with the English language being the language of interpretation.
In the event of a dispute as to the meaning of a term or provision of these Terms of Use, Members may contact L&M by letter sent to 485 Brickell Ave #1908 Miami, FL (USA) or by filling out the contact form, making sure to indicate any personal identifiers. Members may also make claims on the USA online dispute resolution platform.
In accordance with the rules applicable to mediation, prior to any request for mediation, the Member must first have raised any dispute with L&M in writing in order to attempt an amicable resolution of this dispute.
Any disputes between L&M or the Indra Group companies and a Member, including any non-contractual disputes, arising from these Terms of Use or the Services that the Member does not elect to settle by mediation as described above, will be dealt with by the courts of England and Wales, or if a Member is a consumer living in: (i) Scotland, by the courts of Scotland or (ii) Northern Ireland, by the courts of Northern Ireland.

Article 12. About us
